Protection of Plant Varieties
 
  The protection of plant varieties is an examined and registered protective right for plant varieties with a maximum duration of 25 or 30 years in dependence on the type of plant. According to the Plant Varieties Protection Law a plant variety can obtain protection, if it is new, distinguishable, homogenous and unchanging and if it is marked with a registrable denomination of a plant variety. Typical users of the plant variety protection are plant cultivators and seed producers.

Plant variety protection for Germany can be applied for at the Federal Office for Plant Varieties on a national basis, or as community plant variety protection for the entire area of the European Union at the EU Community Plant Variety Office.
