Plant variety protection leads to examined, registered IP rights for plant varieties with a maximum term of 25 or 30 years, depending on the plant species.

According to the Plant Variety Protection Act, a plant variety can receive protection if it is new, distinct, homogeneous and stable and is designated by a registerable variety name. Typical users of plant variety protection are plant breeders and seed producers.

Plant variety protection for Germany can be applied for nationally at the German Federal Plant Variety Office (BSA) or as Community Plant Variety Right for the entire territory of the European Union at the European Community Plant Variety Office (CPVO).
